These Terms and Conditions ("Terms") govern your access to and use of TQSync.com ("the Platform"), operated by Aksara Digital Solutions ("we", "us", or "our"). By registering for or using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By creating an account or using any part of the Platform, you confirm that you:

  • Are at least 18 years of age
  • Have read and understood these Terms
  • Agree to comply with all applicable Malaysian laws and regulations

2. Description of Services

TQSync.com is a SaaS platform providing:

  • Prospect and affiliate team management tools
  • Social media content generation
  • URL and invitation link generation
  • AI-powered chatbot and messaging automation
  • WhatsApp Business API (WABA) integration via Meta's Embedded Signup

Features may be updated, added, or removed at our discretion without prior notice.

3. Account Registration and Security

  • You must provide accurate and complete information during registration.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately at hello@aksara.solutions of any unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 Free Plan A free tier is available with limited features at no charge.

4.2 Paid Plans Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). All fees are stated in Malaysian Ringgit (MYR) unless otherwise specified.

4.3 No Refund Policy All payments are non-refundable. Upon cancellation, your subscription will remain active until the end of your current billing cycle. No partial refunds are issued for unused periods.

4.4 Service Until End of Billing Cycle If you cancel your subscription, you will retain full access to your plan's features until the last day of your paid billing period. After that, your account will revert to the free plan or be deactivated, depending on plan availability.

4.5 Price Changes We reserve the right to change subscription prices. You will be notified at least 14 days before any price change takes effect.

5. WhatsApp Business API Usage

5.1 Meta Platform Compliance By connecting your WhatsApp Business Account (WABA) through TQSync.com, you agree to comply with:

5.2 User Responsibility for Messaging You are solely responsible for:

  • The content of all messages sent through the Platform
  • Obtaining proper consent from recipients before sending messages
  • Ensuring messages are not spam, misleading, or in violation of any law
  • Complying with Malaysia's Communications and Multimedia Act 1998

5.3 WABA Ownership Your WABA remains under your own Meta Business account. Aksara Digital Solutions acts as a technology provider enabling the connection. We do not own or control your WhatsApp Business Account.

5.4 Suspension of Messaging We reserve the right to suspend your messaging access if we receive reports of misuse, spam complaints, or violations of Meta's policies, without prior notice.

6. User Responsibilities

You agree to:

  • Use the Platform only for lawful purposes
  • Not attempt to reverse-engineer, hack, or disrupt the Platform
  • Not use the Platform to transmit harmful, offensive, or illegal content
  • Not share your account access with unauthorised parties
  • Ensure all data you enter complies with applicable privacy laws, including Malaysia's Personal Data Protection Act 2010 (PDPA)

7. Content and Data

7.1 Your Content You retain ownership of all data, content, and prospect information you upload or create on the Platform. By using the Platform, you grant us a limited licence to process your data solely to provide the services.

7.2 AI-Generated Content The Platform includes AI-assisted content generation tools. You acknowledge that:

  • AI-generated content may not always be accurate or appropriate
  • You are solely responsible for reviewing and approving any content before use
  • We make no guarantees about the quality or suitability of generated content

7.3 Data Security We implement reasonable technical and organisational measures to protect your data. However, we cannot guarantee absolute security and are not liable for breaches beyond our reasonable control.

8. Intellectual Property

All Platform software, design, trademarks, and content created by Aksara Digital Solutions are our exclusive property. You may not copy, reproduce, or distribute any part of the Platform without written permission.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted or error-free
  • Results obtained through the Platform will be accurate or reliable
  • Any defects will be corrected within a specific timeframe

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER MALAYSIAN LAW, AKSARA DIGITAL SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES.

Our total aggregate liability to you for any claim arising from use of the Platform shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.

11. Third-Party Services

The Platform integrates with third-party services including Meta (WhatsApp, Messenger, Instagram) and others. We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of such services is subject to their respective terms and policies.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

13. Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion if you:

  • Violate any provision of these Terms
  • Engage in fraudulent or unlawful activity
  • Abuse other users or platform resources

Upon termination, your right to access the Platform ceases immediately. We may retain your data in accordance with our Privacy Policy and applicable law.

14. Modifications to Terms

We may update these Terms at any time. We will notify registered users via email or an in-platform notice at least 7 days before changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
